1. Acceptance of these Terms
These Terms & Conditions (the “Terms”) govern your access to and use of the MESH-API software, source code, documentation, this website, and any related services (collectively, the “Software”). By downloading, installing, copying, accessing, or otherwise using the Software, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not download, install, or use the Software.
2. Open-Source License Controls the Code
MESH-API is open-source software. Your rights to use, copy, modify, and distribute the source code are governed by the license published in the project repository at the LICENSE file. In the event of any conflict between these Terms and that license with respect to the source code, the open-source license controls for the code, while these Terms continue to govern your use of this website and any non-code services.
3. Experimental & Beta Software
MESH-API is experimental, pre-release, beta software provided for hobbyist, educational, and research purposes. It may contain bugs, errors, defects, or security vulnerabilities, and may change, break, or be discontinued at any time without notice. You use the Software entirely at your own risk.
4. No Affiliation with Third Parties
MESH-API is an independent project. It is not affiliated with, endorsed by, sponsored by, or associated with the Meshtastic® project, MeshCore™, or any other third party. Meshtastic® is a registered trademark of Meshtastic LLC. MeshCore™ is a trademark of its respective owner. “Meshtastic,” “MeshCore,” and all other product names, logos, trademarks, and brands referenced are the property of their respective owners and are used for identification and descriptive (nominative) purposes only.
5. NOT FOR EMERGENCY, SAFETY, OR LIFE-CRITICAL USE
The Software is NOT designed, tested, certified, or intended for use in any emergency, safety-of-life, medical, navigation, military, industrial-control, or other mission-critical or life-critical situation. Mesh radio networks and AI components can fail, drop messages, deliver inaccurate information, or be delayed or unavailable. Never rely on the Software where failure could lead to injury, death, property damage, or other loss. Always maintain independent, redundant, and properly certified backup communication methods. You assume all risk arising from any such use.
6. Assumption of Risk & User Responsibility
You are solely responsible for how you configure, deploy, and operate the Software, including compliance with all applicable laws and regulations — including but not limited to radio spectrum, telecommunications, encryption, privacy, data-protection, and export-control laws in your jurisdiction. You are responsible for obtaining any licenses required to operate radio equipment, for the content you transmit, and for the conduct of any AI agents, integrations, or automations you enable. You assume all risks associated with using the Software.
7. NO WARRANTY
THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, the authors, contributors, maintainers, and operators (collectively, the “Providers”) disclaim all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, accuracy, quiet enjoyment, and non-infringement. The Providers do not warrant that the Software will be uninterrupted, secure, error-free, or free of harmful components, or that any defects will be corrected.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, OR FOR PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SOFTWARE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE PROVIDERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROVIDERS’ TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SOFTWARE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID THE PROVIDERS FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (WHICH, FOR FREE SOFTWARE, IS ZERO), OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS; IN SUCH CASES THESE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Indemnification
You agree to defend, indemnify, and hold harmless the Providers from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your access to or use of the Software, your violation of these Terms, your violation of any law or regulation, or your infringement of any third-party right.
10. Third-Party Services, AI Models & Links
The Software may interoperate with third-party services, APIs, AI models, radios, and software (for example, messaging platforms, cloud or local AI providers, and automation tools). The Providers do not control and are not responsible for such third parties, their availability, accuracy, content, terms, or privacy practices. AI-generated output may be inaccurate, incomplete, offensive, or otherwise unsuitable; you are responsible for reviewing and verifying any output before relying on it. Your use of third-party services is governed by those parties’ own terms.
11. Donations
Any donations or contributions are voluntary, non-refundable, and do not create any obligation, warranty, service-level commitment, or support relationship, and do not entitle you to any product, feature, or outcome.
12. Changes to the Software and to these Terms
The Providers may modify, suspend, or discontinue the Software, in whole or in part, at any time without notice or liability. The Providers may also revise these Terms from time to time. The updated Terms become effective when posted on this page, and your continued use of the Software after changes are posted constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict-of-laws principles. You agree that the exclusive venue for any dispute not subject to arbitration or small-claims jurisdiction shall be the state and federal courts located in Clark County, Nevada, and you consent to personal jurisdiction there.
14. Severability & Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. These Terms, together with the applicable open-source license, constitute the entire agreement between you and the Providers regarding the Software and supersede all prior agreements on that subject. Failure to enforce any provision is not a waiver of it.
